1. About us

This website is operated by The Little Preservatory Ltd., a company registered in England and Wales under company number 17260144, with registered office at 14 Westholme Close, Woodbridge, Suffolk, IP12 4BE (“we”, “us”, “our”).

2. These terms

These Terms & Conditions of Sale govern the sale of products through thelittlepreservatory.co.uk.

By placing an order through our website, you agree to be bound by these terms. Please read them carefully before ordering and retain a copy for your records.

These terms should be read together with our Privacy Notice, Cookie Policy, Shipping & Delivery Policy, and Returns & Refunds Policy, all of which form part of the agreement between you and us.

We may update these terms from time to time. The version that applies to your order is the version published on our website at the time you place your order.

3. Our products

All our products are handmade in small batches in Suffolk using locally grown and foraged ingredients where possible. As a result:

• Slight variations in appearance, colour, texture, weight, and quantity between batches are normal and are not defects
• Images on our website are for illustrative purposes only and may differ slightly from the products supplied
• Product availability may vary seasonally and according to ingredient availability

Full ingredient and allergen information is provided on each product page. Please read this information carefully before ordering.

While we take reasonable care in handling ingredients and identifying allergens, our products are prepared in a food production environment where allergens may be present.

Shelf-life information, storage instructions, and best-before dates are provided on product packaging and, where appropriate, on product pages.

4. Placing an order

When you place an order, you are making an offer to purchase goods from us.

We will send an order acknowledgement email after receiving your order. This acknowledgement does not constitute acceptance of your order. A contract between us is formed only when we send you a dispatch confirmation email.

We may refuse or cancel an order where reasonably necessary, including where:

• a product is unavailable
• there is an obvious pricing error
• payment cannot be authorised
• we reasonably suspect fraudulent activity

If we cancel an order after payment has been taken, we will provide a full refund.

5. Prices and payment

All prices are shown in pounds sterling (£).

Delivery charges are shown separately at checkout.

Payment is processed securely through Square at the time of ordering. We do not store your full payment card details.

Although we take reasonable care to ensure pricing information is accurate, errors may occasionally occur. If we discover a pricing error affecting your order, we will contact you before dispatch and give you the option to proceed at the correct price or receive a full refund.

6. Delivery

Delivery times, delivery charges, and delivery areas are set out in our Shipping & Delivery Policy.

Ownership of goods passes to you when we receive payment in full. Risk in the goods passes to you when they are delivered to the delivery address specified in your order.

7. Your right to cancel and returns

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers generally have a 14-day right to cancel online purchases.

However, certain products sold by us are exempt from this cancellation right, including goods liable to deteriorate or expire rapidly, personalised goods, and certain sealed goods that are unsuitable for return once opened.

8. Faulty, damaged or incorrect goods

Under the Consumer Rights Act 2015, goods supplied by us must be: as described; fit for purpose; and of satisfactory quality.

If goods supplied by us do not meet these requirements, you may be entitled to a repair, replacement, or refund in accordance with your statutory rights and our Returns & Refunds Policy.

Nothing in these terms affects your statutory rights.

9. Our liability

We are responsible for foreseeable loss or damage caused by our breach of these terms or our negligence. We are not responsible for loss or damage that was not foreseeable at the time the contract was formed.

Nothing in these terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited under English law.

If you have a food allergy or intolerance, you are responsible for reviewing ingredient and allergen information before ordering or consuming our products.

10. Events outside our control

We will not be responsible for delays or failures caused by events outside our reasonable control, including but not limited to: severe weather; courier disruptions; supply shortages; industrial disputes; power failures; government restrictions; or other circumstances beyond our reasonable control.

If such an event causes significant delay, we will contact affected customers as soon as reasonably practicable.

11. How we use your personal information

We only use personal information in accordance with our Privacy Notice.

12. Complaints and dispute resolution

If you are unhappy with any aspect of our products or service, please contact us at hello@thelittlepreservatory.co.uk and we will do our best to resolve the issue promptly.

We are not obliged and do not currently agree to participate in an alternative dispute resolution scheme. Information about consumer dispute resolution services is available through the Chartered Trading Standards Institute.

13. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. Any dispute arising from these terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

14. Entire agreement

These terms, together with any policies referred to within them, constitute the entire agreement between you and us regarding the sale of products through our website.

15. Severability

If any provision of these terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
